What is Fair Use?

Posted in General at 10 pm

I got it! I got it! I finally got my first one!

Because of the content on this page: Order Somewhere Chaos + karmann-ghia + vic I got my own…

Trademark Infringement Notification!

Woooooooooooooo-hoooooooooooooooo!

No one less than Volkswagen AG of Wolfsburg Germany found that my world-renowned site was an affront to their right to not have to spend money on lawyers.

If I may quote:

Dear Mr. Olson,

we have discovered that under the internet-address: “www.ordersomewherechaos.com” a blank form titled with “Fahrzeug-Identitäts-Urkunde der Stiftung AutoMuseum Volkswagen” can be found. Right beside this title the trademark “VW in circle” is set. There has been no authorization in what way soever between you and the Volkswagen AG to behave in the just described manner.

[…]

By delivering such a blank form via the internet people may get mixed up concerning the origin of this formular. In addition to this the trademark “VW in circle” itself will be diluted. Last but not least the good reputation that consumers associate with this trademark will be dwarfed.”

I realize this is easy to pick on, and I certainly couldn’t write anything coherent in German, but the letter is so funny.

More to the point, it seems odd that having a copy of a form that will be sent out to people would be a trademark issue. Since I’m reporting what was delivered to a member of my ‘audience’, this is fully under US Fair Use laws.

I mean, I’ll take it off, no problem for me, but really, this seems odd and funny.

This same guy wrote an incredible article on Lisp that I end up re-reading every couple of years.

State Songs

Posted in General at 10 pm

I’m listening to South Carolina from They Might Be Giant’s John Linnell album State Songs and really enjoying it. The entire album is hit and miss but this, Utah and a few other are really worth the price of admission.

The State of the Onion 8

Posted in General at 7 pm

From Larry Wall’s The State of the Onion 8:

“One of the aspects of my Asperger personality is that I don’t initiate things like that. I have impaired executive function, in modern terminology. I almost never initiate telephone calls. I almost never initiate anything, in fact. Funny, considering Perl, but nevertheless true.

“The most telling example of that is when Deja first put up all the old Usenet news articles for browsing. My good friend Randal Schwartz went in and discovered that of the hundreds of articles I’d posted over the years, only one article was not a follow-up to some else’s article. I don’t initiate. I have no initiative. I guess that makes me lazy. Oh, well”

To everyone who has ever wondered why I never call, here’s part of the answer I think. I’ll need to read up on this “Asperger” thing some more.

Timbers Crush Islanders

Posted in General at 7 am

Last night’s game rocked! 5 goals by 5 players! Against a total shutout.

I don’t think enough people realized that when Byron scored his goal and ran over the the Army that he was pointing to his shirt because it was his ’15’th goal of the year.

The Portland Timbers clinched 1st place in the Western Conference! No one can touch them in point-standings (Win=3pts, tie=1pt, loss=0pt.)

I’m expecting that a number of the starters will get a rest and some of the bench players will get some minutes in the last two games of the regular season.

Beer Nut? No, Bear Nut

So many puns so little bandwidth…

Bear drinks 36 beers and passes out

The bear apparently got into campers’ coolers and used his claws and teeth to puncture the cans. And not just any cans.

“He drank the Rainier and wouldn’t drink the Busch beer,” said Lisa Broxson, bookkeeper at the campground and cabins resort east of Mount Baker.
